Privacy & Data Protection Policy (POPIA & International Compliance)

At Creativ Recruits, safeguarding your personal information is our top priority. We collect, process, and store personal data responsibly and transparently, in full compliance with South Africa’s Protection of Personal Information Act (POPIA) and relevant international data protection laws, including the General Data Protection Regulation (GDPR) where applicable.

What Data We Collect

We collect only the personal information necessary to deliver our recruitment services. This may include:

  • Full names

  • Contact details (email address, phone number)

  • Employment history, qualifications, and career preferences

  • Supporting documents such as CVs and references

This information is processed solely for recruitment, placement, and communication purposes between you, our clients, and us.

How We Protect Your Data

Your personal information is securely stored and processed using password-protected systems and trusted, compliant software platforms. Our systems use encryption, access controls, and regular security assessments to safeguard against unauthorized access, alteration, loss, or disclosure.

We retain your personal information only for as long as necessary to fulfil recruitment services or as required by law. Unsuccessful candidate profiles will be securely deleted or anonymised after 24 months, unless you provide consent for ongoing consideration. For successful candidates, data may be retained as required in line with client or legal obligations.

Cross-Border Data Transfers

Should your personal information be processed or stored outside of South Africa, we will ensure that appropriate contractual, legal, and organisational safeguards are in place to protect your data in accordance with Section 72 of POPIA and applicable international data protection laws. We regularly review these safeguards to maintain compliance.

Lawful Basis for Processing

We process your personal information based on your consent, the necessity to perform our recruitment services, compliance with legal obligations, and our legitimate interests aligned with recruitment activities.

Your Data Rights

You have the right to:

  • Request access to your personal information

  • Request corrections if any of your information is inaccurate

  • Request deletion of your personal data when it is no longer required for recruitment purposes

  • Withdraw your consent to processing at any time

Information Governance

Creativ Recruits has appointed an Information Officer, whose details have been registered with the Information Regulator and are available upon request. You may contact our Information Officer directly at hello@creativrecruits.com.

Data Breach Protocol

In the unlikely event of a data breach:

  • Affected individuals will be notified within 72 hours of discovery

  • Immediate steps will be taken to contain and investigate the breach

  • The incident will be reported to the Information Regulator as required by law

Your Consent

By submitting your personal information and CV to Creativ Recruits, you consent to us processing and storing your information for recruitment purposes in accordance with this policy.
